Regarding such, the operators of crazysexpics.com confine their actions to the transmission, storage, retrieval, hosting and/or formatting of the content, be it depictions of explicit or of simulated sexual activity, that is supplied by third-party users of the website. All content that is furnished by third-party users is found on areas of crazysexpics.com which are under the control of third-party users. The operators are thus exempt from compliance with Section 2257 records keeping and labeling obligations as specified in 28 C.F.R. §75.1(c)(4). In accordance with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), the operator of the website may remove any images or videos if such are determined, at the operator’s sole discretion, to be indecent, obscene, defamatory, or inconsistent with the polices and terms of use of the website.
All other visual depictions displayed on the website are not subject to the stipulations of 18 USC 2257 Statement and 28 C.F.R. 75 because said visual depictions do not consist of depictions of acts as specifically described in 18 USC 2257 Statement (2) (A) through (D), but are merely depictions of non-sexually explicit nudity, or are depictions of simulated sexual acts, or are otherwise excluded because the visual depictions were created prior to July 3, 1995.
